AVIATION INSURANCE

THE ORIGIN AND PROVISIONS OF INTERNATIONAL REGULATIONS

OF AVIATION INSURANCE Origin;

In 1929, the convention was signed in Warsaw. The convention was an

agreement to establish terms, conditions, and limitations of liability for

international carriage of person’s luggage or goods by air.

The provisions are: 

  • It states the definition of international carriage.
  • It states the limit of carriers liability.
  • It states the rules concerning the liability of the air coverage and its

limitations.

  • It states the limitation period within which a claim must be brought.
  • It states the rules concerning the liability of the air carrier and its

limitation.

  • It states the mandate insurance of passenger ticket and the minimum

requirements.

 

REGULATORY AGENCIES OF AVIATION OPERATION 

  • The primary aviation regulatory body in Nigeria is the Nigerian Civil

Aviation Authority, established under the Civil Aviation Act 2006.

The authority is responsible for regulating air navigation in Nigeria;

Inspection and regulation of aerodromes and aircraft factories; and

personnel licensing. 

  • The International Civil Aviation Organization (ICAO) creates regulations

For aviation safety, security, efficiency and regularity and environmental

protection. The organization also regulates operating practices and

procedures covering the technical field of aviation. 

  • International Air Transport Association (IATA); is a trade association of

The world's airlines founded in 1945. IATA has been described as a cartel

since, in addition to setting technical standards for airlines; IATA also

organized tariff conferences that served as a forum for price fixing.

  • Federal Ministry of Aviation
  • Federal Airport Authority of Nigeria
  • Federal Aviation Administration (FAA) regulates aviation safety and pilot

certification and operates the air traffic control system. It is the largest

modern transportation agency and a governmental body of the United

States with powers to regulate all aspects of civil aviation in the nation as

well as over its surrounding international waters. 

  • The Directorate General of Civil Aviation is the statutory body formed

Under the Aircraft Bill, 2020. This directorate investigates aviation

accidents and incidents. It is headquartered along Sri Aurobindo Marg,

opposite Safdarjung Airport, in New Delhi.
