NOTE

RAPE AND MURDER

Rape is an unlawful sexual activity against the will of the victim through force or a threat of force. It is also a sexual activity with an individual who is incapable of giving legal consent because of minor status, mental illness, intoxication etc.

Types of Rape

  1. Date rape: this is a rape committed by someone who knows the victim
  2. Gang rape: this is when a group of people participate in the rape against the victim
  3. Marital rape: it is a rape between a married couple without spousal consent
  4. Statutory rape: it is when rape occurs between an older person and a child below 18 years of age

 

Murder on the other hand is unlawfully and unjustifiably killing another under circumstances defined by statute

Degrees of murder

  1. First degree: This is a willing and premeditated killing of a person
  2. Second degree: This is a killing that was not premeditated
  3. Third degree: it is killing a person as a result of committing another felony/crime
